Press Release from the Royal Cabinet
"His Majesty King Mohammed VI, Commander of the Faithful and Chairman of the Supreme Scientific Council, issued His High Directives on Friday, Dhu al-Hijjah 21, 1445 AH, corresponding to June 28, 2024, instructing the Council to study issues raised in certain proposals by the commission tasked with reviewing the Family Code (Moudawana), based on the principles and provisions of the true Islamic religion and its benevolent objectives, and to submit a fatwa thereon for His Majesty's High Consideration.
This referral comes after the commission concluded its mission within the set timeframe and submitted its proposals to the Royal Consideration. Given that some proposals pertain to religious texts, His Majesty deemed it necessary to refer the matter to the Supreme Scientific Council—which Article 41 of the Constitution designates as the sole authority qualified to issue fatwas that are officially adopted.
Furthermore, while issuing fatwas on the submitted proposals, His Majesty called upon the Supreme Scientific Council to keep in mind the contents of the High Royal Message addressed to the Head of Government, which advocates adopting the virtues of moderation and constructive open Ijtihad (independent reasoning), within the framework of the principle long expressed by His Majesty: not permitting what is unlawful to be made lawful, nor what is lawful to be made unlawful."
